We ask you to carefully read these Terms, as you accept these Terms by using the Platform.

Introduction

These user terms ("Terms") govern our relationship with end-users ("you") who use our Platform (as defined below).

The Platform is offered by YG Technologies AS in Norway, (enterprise number 917 997 748) ("Bygr", "we", "us"). For the sake of good order, these Terms applies separately and in addition to the license agreement we have entered into with corporations that operate in the construction industry ("Customers").

You are provided with a free access to the Platform, as you have been approved by a Customer with which you are affiliated with. Note that a breach of these terms could result in the termination of a license agreement with a Customer. If you for some reason have gained access to our Platform without the prior approval of a Customer, please discontinue your use immediately and contact us.

The Platform may include links to third party websites or applications. Such websites or applications are subject to separate terms and conditions provided by the relevant third party.

We are not responsible for the content on such websites and applications.

About the platform

The Platform is a web-based interface that we make available to access through your web browser you may have access to an app-based interface that we make available for download on certain app stores.

You may choose if you want to use the web-based or app-based interface, or both. The Platform enables seamless interaction and collaboration between actors and participants in building projects. You may, amongst other things, upload agreements, or other documents, place orders, manage requests and change requests, receive quotes from sub-contractors and send offers for digital signature.

In addition to the core modules, features and functionality available in the Platform at present, we may also make available premium modules, features or functionality that you may subscribe to. Such premium modules or functionalities may be subject to specific terms and conditions, including payment, which you will have to agree to in order to access and use them.

You acknowledge and agree that we may update the Platform from time to time, and that this may result in changes or discontinuation of modules, features or functionality.

The relationship with other parties

We are not construction professionals, and we do not discuss or advise on any issues relating to construction. Accordingly, the contractor, sub-contractor or other third parties selling goods or offering services on or through the Platform are responsible for all services, advice, goods, or similar offered on our through our platform.

‍Bygr is not responsible for the correctness or completeness of any of the information communicated on or through the Platform. If you discover information that is inaccurate or incomplete, please contact the relevant provider of the information.

Your user account

In order to use the Platform, you must have received an invitation from Us, a Customer or a colleague who has created a company profile, and subsequently registered your own user account on the Platform.

When registering your account, we will ask you to provide necessary credentials, such as your name, address, phone number, and password.We encourage you to use strong passwords (passwords must contain a minimum of 8 characters, and include the combination of upper and lower case letters and a number) to protect the privacy of your account.

You must take all reasonable steps to safeguard your login name and password. This includes not revealing them to other people; not leaving your device unattended when logged onto the Platform; and not keeping a physical record of your user name and password.You must ensure that the information is correct.

You are not allowed to register an account with information that belongs to others. You are solely responsible and liable for all actions your account, this includes all orders, purchases, agreements and similar.

Payment

The use of the core modules, features and functionality of the Platform is free of charge for end-users. However, we do not guarantee that your use of the Platform will be free in the future.

You may be charged fees for premium modules, features and functionality, provided that you have signed up for such, and that we have previously notified you in writing of the fees to be charged.

Data protection

In order to enable you to use the Platform, we need to receive, use and store some of your personal data. For more information about our processing of your personal data, we refer to our privacy policy available on our website

Intellectual property

Nothing in these Terms shall be construed as a transfer or assignment of any intellectual property rights to you. In particular, Bygr retains all right, title and interest in all intellectual property rights related to the Platform.

Abuse of the Platform

All use of the Platform shall be in accordance with these Terms and with applicable laws and regulations. Any breach of these Terms or any other unacceptable behaviour, as freely determined by Bygr, will be considered as abuse of the Platform.

We reserve the right to prevent or stop such abuse. If we suspect such abuse, we are entitled to delete or deactivate your end user account.

Disclaimer

Your use of the Platform is at your own risk. To the fullest extent allowed by applicable law:

‍The information and services provided via the Platform are provided "as is" and "as available" and without any warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, secure or error-free, or that the information will be accurate, adequate, current or complete.

We may at any time and without notice modify the Platform, or withhold, suspend or restrict any service available through the Platform. We expressly disclaim any liability which is based on, or arises out of, the information accessed using the Platform.

We assume no responsibility for consequences relating directly or indirectly to any action or inaction you take based on the information available through the Platform.

Limitation of liability

To the extent permitted by law, unless caused by our gross negligence or wilful misconduct, we will not be liable to you or any third party for any direct, indirect, or consequential costs, claims, demands, actions, losses, damages, or other liabilities resulting from:

- your use of the Platform;

- any unauthorized use of your user name and password;

- any delay or loss of access to, or use of the Platform at any time, or any fault or error in the design, content, or engineering of the Platform and third party services;

- any suspension or restriction of any service available through the Platform;

- malfunction of any equipment or system, or any telecommunications link failure;

- or any cause or event reasonably beyond our control.

Governing law and disputes

Subject to applicable law, the Terms shall be governed by and interpreted in accordance with the laws of Norway.

Any dispute, controversy or claim arising out of or in connection with the Terms shall be subject to the jurisdiction of the courts of the domicile of Bygr, or your domicile if you acting as a consumer.

Alteration of Terms
